John R. Haug
Partner
John Haug's practice includes construction,
architectural, engineering and development law (including related
finance).
He is actively engaged in the financing,
negotiation, evaluation and development documentation of
significant public and private design and construction projects
throughout the United States and abroad.
John has represented clients in a variety of
major vertical and horizontal construction projects, including
regional malls and shopping facilities, highways, sports
facilities, industrial manufacturing facilities, gaming complexes,
prison facilities, condominium and multi-unit residential housing
developments, hospitals, luxury hotels and resorts, refineries, and
government remediation projects.
In addition, John represents major pipeline
and energy transportation companies in connection with all aspects
of the construction and operation of significant petroleum pipeline
and storage systems. John also has significant experience working
with solar energy providers.
John's experience in the pipeline transportation and energy
areas include the following:
- Right-of-way acquisition including
multi-state condemnation procedures;
- Federal and State environmental permitting
and compliance;
- Federal, state and local regulatory
compliance, including archeological, migratory waterfowl and
endangered species issues;
- Engineering compliance issues, including
floodplains and wetlands matters;
- Horizontal engineering and construction
issues, including project administration;
- Zoning, permitting and related administrative
procedure issues;
- Crossing permits and agreements;
- Temporary workspace acquisitions;
- Project fee acquisitions;
- Project remediation and reclamation
procedures;
- Solar power purchase agreements;
- Solar lease agreements;
- Master agreements with regard to solar
construction projects;
- Solar easements and purchase option
agreements.
John's experience in the construction and development area
includes the following:
- Negotiating and drafting (including AIA
modifications) construction contracts and related general
conditions, subcontracts, construction management agreements,
supply agreements, design/build contracts, build-to-suit leases and
agreements for the provision of architectural and engineering
services;
- Preparing other documents relating to the
construction industry, including letter agreements, notices of
intent, mechanic's liens, joint venture agreements, easements,
escrow and disbursing agreements, requests and invitations for bids
and proposals and communications to sureties, contractors and
construction managers necessary to preserve and pursue claims;
- Prosecution and defense of claims in
litigation or arbitration (and related mediation) with respect to
design, development and construction issues, including:
contract disputes; delay, work disruptions, compression and
acceleration claims;
- disputes arising from differing or
unanticipated site conditions;
- errors and omissions claims;
- bid protests;
- performance and payment bond claims;
- claims relating to maintenance bonds, bid
bonds and license and permit bonds;
- warranty claims;
- mechanic's and material men lien foreclosure
action's defective engineering claims;
- defective construction and warranty claims;
insurance coverage disputes;
- building code and regulatory compliance
issues;
- Americans with Disabilities Act and other
accessibility requirements issues;
- Counseling and advice with respect to
bankruptcy and work out issues in connection with troubled
development and construction projects, including the prosecution of
related claims and adversary proceedings;
- Counseling and advice with respect to
minority and disadvantaged business enterprise compliance,
including the negotiation and documentation of related joint
ventures, mentor protégé programs and administrative compliance
proceedings;
- Counseling and advice with respect to
construction, architectural and engineering insurance and bonding
issues, including performance, payment, maintenance and guarantee
bonds, builder's risk, OCIP, and other project specific insurance
programs;
- Negotiation and documentation of construction
project finance, including tax credit financing, tax increment
financing, and HOPE IV;
- Counseling and advice with respect to the
formation of vertically and horizontally integrated joint
participation programs, including joint venture agreements, and
project specific limited liability partnerships and
corporations;
- Counseling and advice with respect to
construction and errors and omissions claims analysis and
preparation, including damage quantification issues;
- Counseling and advice with respect to
contract termination issues, including related damage, contract
assignment and remobilization/completion issues;
- Counseling and advice with respect to
construction administration issues, including the contractual
change order and payment application process and retainage
administration;
- Counseling and advice regarding construction
and design intellectual property issues, including the negotiation
and documentation of applicable licensing, non-disclosure and
confidentiality agreements;
- John is a member of the Missouri Bar
Construction Law Section and a frequent lecturer on construction,
development, architectural and engineering issues.

John is a member of the Missouri Bar

litigation.
Prior to joining SNR Denton, John was a
partner at Bryan Cave LLP.
He is admitted to practice in Missouri, Illinois and the
United States District Court, Eastern District of Missouri.
